Attorney Christine Nentwig has recently been certified by Chief Judge Matthew W. Brann as a federal court mediator in Labor and Employment Law for the United States District Court Middle District of Pennsylvania. What is the Pregnant Workers Fairness Act (PWFA)?
The Pregnant Workers Fairness Act (PWFA) is a federal law, which requires covered employers to provide reasonable accommodations to a qualified worker’s known limitations related to pregnancy, childbirth, or related medical conditions, unless the accommodation will cause the employer an undue hardship. This new statute is very similar to the Americans with Disabilities Act (ADA), which excludes pregnancy alone (absent medical complications) from the definition of disability. Like the ADA, reasonable accommodations may include modifications to the work environment or job processes.
